Motiva Patents has been involved in litigation with many larger companies including Sony, Facebook, and Nintendo for a Human Movement Measurement System, which are included in the Smart Footwear sector. Motiva lost an ITC case against Nintendo because Motiva did not did not satisfy the economic prong of the domestic industry requirement of § 337 of the Tariff Act of 1930.
